The notice of defect deadline (Rügefrist) is a period within which a contracting party must file a notice of defect (Mängelrüge) upon discovering a defect in the delivered goods or services. The notice of defect deadline serves to give the other contracting party the opportunity to remedy the defect or provide a replacement. It is usually stipulated in the contract and can be individually agreed upon by the contracting parties.
It is important that the notice of defect deadline is observed, as otherwise the consumer's warranty claims may expire. If no notice of defect deadline is stipulated in the contract, the statutory deadline of two months from the discovery of the defect applies.
